1. About These Terms
These SMS Terms & Conditions ("Terms") govern your participation in the Texas Auto Mart SMS Program (the "Program"), operated by Texas Auto Mart ("we," "us," "our"), a Buy Here Pay Here automobile dealership located at 4906 Rigsby Ave, San Antonio, TX 78222. By opting in to the Program, you agree to these Terms.
2. Program Description
The Texas Auto Mart SMS Program is a transactional and customer-care messaging service that delivers account-related SMS messages to customers and prospective customers who have opted in. Messages may include:
- Payment reminders for financed vehicles
- Past-due payment notifications
- Insurance lapse warnings (full coverage is required per your finance agreement)
- Promise-to-pay confirmations
- Replies to inbound customer service inquiries
- Sales follow-up for individuals who have visited our lot and provided contact information
3. How You Consent (Opt-In)
You provide express written consent to receive SMS messages from Texas Auto Mart by completing the online credit application at apply.texasautomart.net and checking the optional, unchecked Text Message Notifications consent checkbox before submitting the application. The checkbox is not pre-checked and is not required to complete or submit the application.

4. Message Frequency
You will receive up to 4 messages per month from the Program, depending on the status of your account.
5. Message and Data Rates
Message and data rates may apply. Texas Auto Mart does not charge you to participate in the Program, but your wireless carrier may charge you for sending or receiving SMS messages. Check with your wireless carrier for details.
6. How to Opt Out
You may opt out of the Program at any time. To stop receiving messages, reply STOP to any message you receive from us. We also accept the following opt-out keywords: OPTOUT, CANCEL, END, QUIT, UNSUBSCRIBE, REVOKE, STOPALL.
After opting out, you will receive one final confirmation message that you have been unsubscribed. You will not receive further messages unless you re-subscribe by replying START.

8. Mobile Information Sharing
Texas Auto Mart will not share, sell, or transfer mobile information (phone numbers, SMS opt-in data, consent records, or message content) to any third parties or affiliates for marketing or promotional purposes at any time. No mobile opt-in data is shared, sold, or bought with respect to third parties or affiliates. The only third party that processes your mobile number is our SMS messaging service provider (currently Twilio), which transmits messages on our behalf under a service contract that prohibits use of your data for any other purpose. 9. Carrier Liability
Wireless carriers (including but not limited to AT&T, Verizon, T-Mobile, Sprint, U.S. Cellular, and their affiliates) are not liable for delayed or undelivered SMS messages. Message delivery is subject to the carrier's terms and effective service area.
10. Eligibility
The Program is available only to individuals (a) located in the United States, (b) at least 18 years of age, and (c) who use a mobile phone serviced by a participating U.S. wireless carrier. You may only opt in using a mobile telephone number that you own or have authority to provide.
11. Compatible Devices and Carriers
The Program is intended for use with SMS-capable mobile devices on participating wireless carriers. We do not guarantee compatibility with any specific device, carrier, or operating system.
12. Changes to These Terms
We may modify these Terms at any time. Material changes will be reflected in the Effective Date above. Where required by law, we will notify active subscribers of material changes. Continued participation in the Program after a change to these Terms constitutes your acceptance of the updated Terms.
13. Termination of the Program
Texas Auto Mart reserves the right to suspend, modify, or terminate the Program (in whole or in part) at any time, with or without notice.
14. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law principles.
